- ORGANIZING COMPANIES:
The companies COLORBABY S.L. with address for these purposes in Ibi (Alicante) 03440, Calle Córdoba 15, Pol Industrial Alfas I CIF No. B-03170578 (Hereinafter COLORBABY) and GOLD DIVISION, S.L. with address in Elche (Alicante), Calle Xixona 3, CIF Nº B-02997625 (Here in after CONGUITOS) are carrying out a promotion through the social network Instagram, in which you can get 3 batches of Baby Gemmy products (valued at 80€ each one) from COLORBABY + 3 batches of Conguitos products (valued at 80€ each).
- TERM AND GEOGRAPHIC SCOPE OF THE PROMOTION
The term of the promotion will run from November 7, 2021 to November 14, 2020 (ending at 23:59 Central European Time). Anyone residing in Spain (only peninsula and the Balearic Islands) can participate.
The promotion will be carried out through the social network Instagram.
- PARTICIPANTS
The promotion is open to all individuals over 18 years of age who meet all the requirements for participation established in these rules.
The organizers reserve the right to ask participants for a document proving the personal data provided and especially their age.
- PROMOTED PRODUCT, FREE OF CHARGE AND COMMUNICATION OF THE PROMOTION.
4.1 The participation in the Giveaway is limited to the followers of COLORBABY and CONGUITOS who are residents in Spain and of legal age.
Even so the above, it is forbidden the participation in the Giveaway to all those persons linked professionally or professionally with COLORBABY or CONGUITOS and to those persons and/or companies that have the consideration of clients and/or suppliers of COLORBABY or CONGUITOS, reaching such prohibition to their direct relatives and/or related persons.
- MECHANICS OF THE PROMOTION
5.1 COLORBABY will select the winners among the comments made in the publication where the promotion is announced, following the instructions in section 5.2. The winner will get as a prize 1 set of Baby Gemmy products (including 1 XL Baby Gemmy Unicorn Egg + 6 Baby Gemmy small eggs (3 Unicorn / 3 Dragon) + 2 Unicorn/Fantasy Shoes of their choice. In the event that the winner cannot be contacted within 48 hours as stated in clause 7, they will be replaced by the corresponding alternate. The selection of the winner and/or alternates will be made randomly through a tool designed for this purpose.
Two alternates will be selected in the event that the winner cannot be contacted within 48 hours as stated in clause 7.
5.2 To participate in the promotion, interested parties will have to follow the following steps:
- Follow the Instagram profile @colorbaby_toys and @conguitos.
- Like the publication where the promotion is announced.
- Mention a real friend by leaving a comment in the publication where the promotion is announced.
5.3. In relation to comments.
- The submission of comments by users implies the automatic and full acceptance of these rules and conditions of participation. However, the winner may be asked to expressly accept the following rules in writing.
- Each publication and comment will be considered as one participation, and there is no limit to the number of participations, as long as the previously indicated requirements are met.
- The publications and/or comments of the participants must be of their authorship, otherwise, COLORBABY and CONGUITOS are exonerated from any type of responsibility.
- For the purpose of a correct participation, only comments whose message is correct according to the following moderation rules will be admitted:
- It is only allowed to publish content for which you have copyright or express authorization of its author.
- Any publication that is sexist, racist, that promotes violence or that is contrary to sexual, religious or opinion freedom is forbidden.
In any case, the right is reserved to delete comments that do not respect the above rules and to exclude them for the purpose of participation.
- GIFTS
6.1 The following products are assigned to the present promotion as gifts:
- 1 batch of Baby Gemmy products + 1 batch of Conguitos products.
6.2 The gift of this promotion can not be exchanged for its amount in cash, nor be subject to any change, alteration, compensation or transfer at the request of the winner.
6.3 COLORBABY and CONGUITOS reserve the right to substitute, for any reason, the prize for another of similar characteristics and of equal or higher value.
6.4 The gift will be accepted purely and simply and in the conditions and form established in these rules, by the mere fact that the winner receives the corresponding gift. The waiver of the prize by the winner shall not entitle him/her to any right of indemnity or compensation.
6.5 The winner will be responsible for any fiscal or tax charge that the acceptance of the prize could imply, as well as any other expense derived from the promotion that is not expressly assumed by COLORBABY and CONGUITOS in the present Legal Bases.
7.DELIVERY OF THE GIFTS
The communication of the gift will be made by private message through the Instagram network to the winner, requiring in that case, and only to the winners, to fill in their personal data in the form developed for that purpose.
If after 48 HOURS it has not been possible to contact the winners or they have not accepted the gift, filling in the personal data, it will be understood that they have renounced the prize, passing the prize to the alternate.
The name of the winners will be published in the publication of the sweepstakes on the Instagram profiles @colorbaby_toys and @conguitos.
The prize will be delivered to the winner at the address that he/she has indicated in the form developed for this purpose.
- MODIFICATION OR CANCELLATION
COLORBABY and CONGUITOS reserve the right to make any change, modify, extend, suspend or cancel the promotion during the development of the same, committing themselves to communicate with sufficient time in advance the new rules.
- GENERAL CONSIDERATIONS
9.1 The employees of COLORBABY and CONGUITOS, as well as the employees of those companies integrated in the realization of the present promotion, and those persons who are related up to the second degree of consanguinity and affinity and the spouses and common-law partners of the above mentioned, as well as those under 18 years of age, are not allowed to participate in the present promotion.
9.2 The simple participation in the promotion implies the acceptance of the rules without reservations, therefore the manifestation in the sense of not accepting all or part of them will imply the exclusion of the participant and as a consequence COLORBABY and CONGUITOS will be released from the fulfillment of the obligation contracted with the participant.
9.3 COLORBABY and CONGUITOS reserve the right to justifiably eliminate any participant who defrauds, alters or makes useless the good functioning and the normal and regulated course of the present promotion.
9.4 COLORBABY and CONGUITOS reserve the right to take legal action against those persons who carry out any type of act that could be considered manipulation or falsification of the promotion.
9.5 COLORBABY and CONGUITOS are not responsible for the possible losses, deteriorations, thefts, delays or any other circumstance attributable to third parties that could affect the development of the present promotion.
9.6 The awarded participants exempt COLORBABY and CONGUITOS from any responsibility derived from any damage that they could suffer during the enjoyment of any of the prizes object of the present promotion.
9.7 Likewise, the participants exempt COLORBABY and CONGUITOS from any responsibility regarding the property or right of use of the material used in their commentary.
9.8 After the end of the promotional period no claim will be accepted.
9.9 The promotion is not sponsored, endorsed, administered or associated in any way with the social network Instagram, so participants release the latter from any liability for any damages arising from it.
- RESOLUTION OF CONTROVERSIES.
For any controversy that could arise in the interpretation and application of the present rules, the participants accept the criteria of COLORBABY and CONGUITOS regarding the resolution of any question derived from the present promotion, being their decision unappealable.
Nevertheless, and in a subsidiary way, both the participants of this promotion and COLORBABY and CONGUITOS, renouncing to their own jurisdiction if any, expressly submit themselves to the Jurisdiction of the Courts and Tribunals of Alicante to solve the differences that could arise in the interpretation and execution of these rules.

The personal data will not be disclosed to third parties, except in the cases legally provided for that purpose.
